GROUP I MAINS POLITY


" WHAT APPLIES TO A MAN, APPLIES TO A WOMEN" THE STATEMENT GIVEN BY A CHIEF JUSTICE OF INDIA IN THE SABARIMALA TEMPLE ENTRY CASE. IN THIS CONTEXT EXPLAIN THE CONSTITUTIONAL PROVISIONS FOR WOMEN.
       In the recent judgement of Supreme court in the sabarimala temple entry case, chief justice of India said that " In a public place of worship, a women can enter, where a man can go and he also asserted, what applies to a man, applies to a women according to Article 25 and 26.

Constitutional provisions for women.

  • Art 15(3) allows the state to make special provisions for women and children. Several acts such as Dowry Prevention act have been passed and protection of women from domestic voilence act 2005.
    Art 23, Under the fundamental right against exploitation, flesh trade has been banned.
  • In the sabiramala temple entry case chief justice of India qutoed Article 25(1), which mandates reedom of conscience and right to practice religion." All persons are equally entitled to freedom of conscience and the right freely to profess, practice and propagate religion..."
  • Art 39, It ensures equal pay to women for equal work.( SC held that the concept of equal pay for equal work in the case of Randhir sing vs Union of India case, it is indeed a constitutional goal and is capable of being enforced through Constitutional remedies under Art 32).
  • Art 40, provides 1/3 reservations for women in Panchayats.
  • Art 42, provides free pregnancy care and delivery.
  • Art 44, It urges the state to implement Uniform civil code, which will help to improve the conditions of women across all religions. However, it has not been implemented.
